SCOTUS TAKES ANOTHER STEP TO ENDANGER AMERICAN RIGHTS

Justice Anthony Kennedy, often the swing vote on this Supreme Court, has announced he is retiring from the Supreme Court.
Justice Kennedy will probably be most remembered for his decision with respect to equal protection under the law for same sex marriage.
Abortion rights were also hanging in the balance with Justice Kennedy, so women’s health care rights could be in jeopardy.
President Trump and Republicans in the Senate will not want another young conservative appointed to the court, but there could be a bump in the road to this destination.
Republicans removed the filibuster rule with respect to Supreme Court Justices in order to ratify Neil Gorsuch’s appointment, and with Sen. John McCain’s absence there is only a one-vote margin for Republicans in the Senate if an appointment is made during this term. If Democrats regain control of the Senate after the midterm elections they could potentially block any Trump nominee. That might mean the seat would remain unfulfilled unless the President could be convinced to nominate someone acceptable to the Democrats. And if Democrats gain control of the White House and the Senate in 2021, they could appoint their own choice.
It simply means much more is riding on the midterm election on November 6, 2018.
